MDCO Sues Again For Extension Of Angiomax Patent

Law360, New York (March 30, 2010, 1:16 PM EDT) -- The Medicines Co. has again sued the U.S. Patent and Trademark Office, seeking to set aside the agency's second denial of an application to extend the principal U.S. patent covering anti-coagulant Angiomax.

The USPTO's March 19 decision to deny MDCO's application for a patent term extension under the Hatch-Waxman Act in the face of a contradictory court order was arbitrary and capricious, and an abuse of discretion in violation of the Administrative Procedure Act, MDCO said in a lawsuit filed Thursday in the U.S. District Court...
