Hospice Org. Beats Nurses' On-Call Wage Suit

Law360, New York (March 31, 2010, 6:05 PM EDT) -- A federal judge has granted summary judgment to a Wisconsin hospice organization in a suit filed by nurses who alleged they should be paid minimum wage for time they spent on call.

Judge William C. Griesbach in the U.S. District Court for the Eastern District of Wisconsin on Monday granted Unity Limited Partnership’s motion for summary judgment in the Fair Labor Standards Act suit, saying Unity’s rules do not prevent the plaintiffs from engaging in social activities either explicitly or de facto.
