Visteon Retirees' Appeal For Benefits Falls Flat

Law360, New York (April 1, 2010, 6:18 PM EDT) -- A federal judge has upheld Visteon Corp.'s decision to yank its retirees' health care, but he granted some of the retirees a month's reprieve to mount an expedited appeal.

Visteon must pay the Consolidated Omnibus Budget Reconciliation Act and third-party insurance costs for its non-Medicare-eligible retirees until April 30, Judge Michael M. Baylson of the U.S. District Court for the District of Delaware said in an order filed Wednesday. His decision upholds a December bankruptcy court ruling.
