OnStar Wins Bid To Disarm Emergency System Patent

Law360, New York (April 9, 2010, 4:26 PM EDT) -- A federal judge has sided with OnStar LLC in a declaratory judgment suit against Micral Inc. over a patent for an emergency telephone system, finding that the patent is unenforceable due to a Westman Champlin & Kelly PA attorney's inequitable conduct.

Judge Patricia A. Gaughan in the U.S. District Court for the Northern District of Ohio ruled Wednesday that attorney Joseph Kelly of Westman Champlin, who submitted the application to the U.S. Patent and Trademark Office, withheld material information with an intent to deceive.
