Gray Insurance Off Hook In Coverage Spat Over Boiler

Law360, New York (April 12, 2010, 4:32 PM EDT) -- A federal judge has shot down Westchester Surplus Lines Insurance Co.'s bid for a declaration that The Gray Insurance Co. Inc. had to indemnify it for fees and costs related to its defense of Furnace and Tube Service Inc. in an underlying lawsuit over an allegedly defective boiler.

Judge Louis Guirola Jr. of the U.S. District Court for the Southern District of Mississippi signed off on an opinion and order on Thursday granting Gray's bid for summary judgment and throwing out Westchester's third-party declaratory judgment complaint....
