SEC Appeals Toss Of ESSI Exec Backdating Suit

Law360, New York (April 13, 2010, 5:21 PM EDT) -- The U.S. Securities and Exchange Commission is appealing the dismissal of a stock options backdating case against the son of the former chairman of defense contractor Engineered Support Systems Inc., who served as a member of the company's board.

The agency filed its notice of appeal Monday in the U.S. District Court for the Eastern District of Missouri after Judge Jean Hamilton dismissed the claims brought against Michael F. Shanahan Jr. on the 10th day of a jury trial in February.
