Medtronic Faces More Suits Over Pacemaker Recall

Law360 (January 10, 2007, 12:00 AM EST) -- Medical device maker Medtronic Inc. may have to pay health insurers for the cost of replacing thousands of recalled pacemaker defibrillators, after a Minnesota judge set the stage for the consolidated complaint brought by insurers to continue to trail.

In an oral order at a hearing last Thursday, Judge James Rosenbaum denied Medtronic’s motion to dismiss two consolidated complaints, one brought by third-party payors, such as health insurance companies, and another brought by individuals, such as patients and their heirs.
