11th Circ. Revives Fla. Firefighters' Race Bias Suit

Law360, New York (April 15, 2010, 2:03 PM EDT) -- A federal appeals court has reversed an order throwing out a race discrimination suit brought by black firefighters against the city of Pensacola, Fla., saying the lower court created confusion by changing a filing deadline.

The U.S. Court of Appeals for the Eleventh Circuit ruled Wednesday that the lower court, which contended the plaintiffs filed their arguments after the deadline, abused its discretion by refusing to consider the arguments before granting summary judgment to the city. It remanded the case to the lower court.
