USPTO To Reexamine Patents In Judgment Vs. eBay

Law360, New York (June 17, 2004, 12:00 AM EDT) -- The U.S. Patent and Trademark Office has granted eBay’s petition to reexamine the auction technology patents at the center of MercExchange’s $29.5 judgment against the online auction site.

In May of last year, a jury decided in MercExchange’s favor and ordered eBay to pay Woolston's company, MercExchange LLC, $35 million in damages. U.S. District Judge Jerome B. Friedman later lowered the amount of damages to $29.5 million and did not prohibit eBay from continuing to sell fixed-price goods.
