Supreme Court Remands FELA Liability Case

Law360 (January 10, 2007, 12:00 AM EST) -- The U.S. Supreme Court vacated a decision from the Missouri Court of Appeals Wednesday and remanded the case, which fell under the Federal Employers’ Liability Act, agreeing with the petitioner that the jury instructions for contributory and employer negligence should be the same.

The Northern Suffolk Railway Co. appealed to the High Court in a case from Missouri state court that had been brought by an employee, Timothy Sorrell, who was injured while driving a dump truck for the railroad.
