Insurers Off Hook In Bug Repellent False Ad Suit

Law360, New York (April 16, 2010, 3:29 PM EDT) -- The insurers for Buzz Off Insect Shield LLC, a maker of insect repellent clothing, had no duty to defend the company against a false advertising suit brought by bug spray maker S.C. Johnson & Son Inc., the Supreme Court of North Carolina has ruled.

The court found on Thursday that while the policies issued to Buzz Off by Harleysville Mutual Insurance Co. and Erie Insurance Co. may cover injury resulting from some false statements made in advertisements, they do not cover injury related to false statements...
