Dallas Sued Over Law Favoring Natural Gas Taxis

Law360, New York (April 16, 2010, 3:24 PM EDT) -- A new Dallas ordinance giving preference to taxis that run on compressed natural gas is illegal because it is preempted by the Clean Air Act, taxi drivers allege in a new suit.

The Association of Taxicab Operators USA filed its lawsuit Thursday in the U.S. District Court for the Northern District of Texas, arguing the Dallas law is preempted because automobile emissions are a matter of federal policy under the Clean Air Act.
