High Court Seeks SG's View On Act Of State Doctrine

Law360, New York (April 19, 2010, 1:23 PM EDT) -- The U.S. Supreme Court on Monday asked the solicitor general to provide the federal government's views on whether a mining pollution suit against a company absorbed by Barrick Gold Corp. raises a federal question under the act of state legal doctrine.

The case centers on allegations that Placer Dome Inc.'s controversial Marcopper mine on the island of Marinduque, Philippines, wrought human health, ecological and economic damages for 30 years, in violation of several of the Philippines' environmental laws.
