Bayer Drops Case Against Lupin Over Generic Cipro

Law360, New York (April 21, 2010, 1:46 PM EDT) -- Bayer Schering Pharma AG has dropped its two-month-old patent infringement suit over Indian drugmaker Lupin Ltd.'s plans to introduce generic versions of the antibiotic Cipro.

Judge Benson Legg of the U.S. District Court for the District of Maryland on Tuesday approved Bayer's voluntary motion to dismiss the case without prejudice.

Lupin has answered a related patent infringement complaint in the District of Delaware and that lawsuit will go forward, Bayer spokeswoman Marcy Funk told Law360.

Lupin had yet to enter an appearance in the Maryland case....
