Lenders Fight Examiner Bid In Flowers Funds' Ch. 11

Law360, New York (April 22, 2010, 12:39 PM EDT) -- Lenders are fighting the appointment of an examiner in the Chapter 11 proceedings of a group of investment funds managed by J.C. Flowers & Co. LLC, arguing that the move would have a disruptive effect on already contentious litigation.

In a filing Tuesday in the U.S. Bankruptcy Court for the District of Delaware, the lenders said no examiner should be appointed “unless and until” the court determines at an upcoming trial that a Chapter 11 trustee is not warranted in the case.
