Brown Seeks Crackdown On Worker Misclassification

Law360, New York (April 23, 2010, 1:18 PM EDT) -- Sen. Sherrod Brown, D-Ohio, has unveiled legislation that aims to beef up efforts to end the misclassification of independent contractors by boosting educational outreach to employers and employees while increasing penalties and regulatory tools to root out violators.

The Employee Misclassification Prevention Act, S. 3254, introduced Thursday, would amend the Fair Labor Standards Act to require companies to keep records of nonemployees who work as independent contractors and to provide special penalties for misclassifying those workers, thereby cutting off their access to certain benefits and workplace...
