Telstra Accuses Watchdog Of Unconstitutional Meddling

Law360, New York (January 16, 2007, 12:00 AM EST) -- Australia’s telecommunications giant Telstra has accused the country’s consumer watchdog of abusing its regulatory powers and breaching the constitution.

Citing sensitive documents the company obtained through Freedom of Information laws to support its case, Telstra claims the Australian Competition and Consumer Commission’s behavior was worthy of a High Court challenge.

A Telstra spokesman, Rod Bruem, confirmed Tuesday a challenge could be brought to the High Court this year, but a decision would not be made for several weeks.
