LG Gets Appeal To Decide $50M Circuit City Question

Law360, New York (April 27, 2010, 6:14 PM EDT) -- LG Electronics USA Inc. has won leave to appeal a bankruptcy court ruling that lets Circuit City Stores Inc. withhold $50 million in administrative claims from several creditors pending the resolution of preference payments.

The question of whether Bankruptcy Code Section 502(d) can be used to bar claims filed under Bankruptcy Code Section 503(b)(9) is worth a look, Judge Robert Payne of the U.S. District Court for the Eastern District of Virginia said in orders filed Monday and Tuesday.
