Vigilant Off Hook For Novell Defense In Unix Fight

Law360, New York (April 28, 2010, 1:30 PM EDT) -- A federal judge has ruled that Vigilant Insurance Co. is not obligated to pay Novell Inc.'s defense costs in a dispute with another technology company over the rights to the Unix operating system.

Judge Ted Stewart granted Vigilant's motion for summary judgment in the U.S. District Court for the District of Utah on Tuesday, saying there were no claims in Novell's underlying lawsuit with The SCO Group Inc. that could give rise to a duty to defend.
