Court Accepts Travelers' Business Loss Calculation

Law360, New York (April 29, 2010, 6:03 PM EDT) -- A federal judge has sided with Travelers Indemnity Co. of Connecticut in a dispute over the methodology to use to calculate loss of business income under an insurance policy that does not specify a formula for the calculation.

Judge A.J. McNamara of the U.S. District Court for the Eastern District of Louisiana granted summary judgment to Travelers on the calculation methodology, rejecting the method proposed by Legier & Co. APAC, the accounting firm claiming the lost income under its insurance policy.
