Per Ricci, 2nd Circ. OKs Police Challenge To Race Order

Law360, New York (April 30, 2010, 4:00 PM EDT) -- Citing the Supreme Court's Ricci decision, a federal appeals court has ruled that a group of eight white and Hispanic officers and one aspiring applicant for the Bridgeport, Conn., police department can intervene to challenge a race-related remedy order that governs hiring and promotions at the department.

A district court improperly denied the officers their right to intervene while the court considers a modified version of the remedy order, the U.S. Court of Appeals for the Second Circuit ruled Tuesday.
