Appeals Court Flips Lloyd's Loss In Contribution Case

Law360, New York (May 3, 2010, 4:28 PM EDT) -- An Oregon appeals court has reversed a loss for certain Lloyd's of London underwriters in a dispute among insurers over how to divvy up a bill covering an environmental claim, finding that Lloyd's should not be penalized because it chose not to settle with the insured.

Though Lloyd's litigated over covering an insured where other companies settled, it should not necessarily bear a disproportionate share of the bill, Oregon's Court of Appeals said in an opinion issued Wednesday.
