5th Circ. Won't Deliver On UPS Drivers' Job Loss Appeal

Law360, New York (April 30, 2010, 6:37 PM EDT) -- A federal appeals court has shot down a group of United Parcel Service Inc. drivers' appeal of a dismissed putative class action alleging the company promised them full-time jobs but then fired or demoted them at the end of a holiday season.

A three-judge panel in the U.S. Court of Appeals for the Fifth Circuit on Friday ruled that the district court was correct in finding that Paris Ditcharo, Eugene Galland and Brett Majoria failed to state a claim.
