DOL's OT Case Over Wash. Social Workers Dismissed

Law360, New York (May 4, 2010, 4:34 PM EDT) -- A federal judge has chucked a lawsuit brought by the U.S. Department of Labor that accused Washington's Department of Social and Health Services of bilking the state's social workers out of overtime pay.

Judge Benjamin H. Settle of the U.S. District Court for the Western District of Washington dismissed the case Thursday after ruling April 26 that the state had "plainly shown" that its social workers met the learned professional exemption under the Fair Labor Standards Act.

Both the DOL and the DSHS declined to comment...
