Validity Ruling Sparks Rolls-Royce Jet Engine IP Suit

Law360, New York (May 6, 2010, 1:33 PM EDT) -- The U.S. Court of Appeals for the Federal Circuit has upheld a finding that Rolls-Royce PLC’s patent for a widely used jet engine is not obvious in light of a United Technologies Corp. patent application, spurring Rolls-Royce to launch an infringement action against its aerospace rival.

On Wednesday, the Federal Circuit downed UTC’s attempt to overturn a district court ruling and reinstate a U.S. Patent and Trademark Office determination that Rolls-Royce’s patent interfered with a UTC jet engine patent.
