Insurer Freed From Defending Silo Collapse Suit

Law360, New York (May 6, 2010, 2:32 PM EDT) -- A Minnesota appellate court has upheld a decision freeing Western National Mutual Insurance Co. from defending Structural Restoration Inc. in an underlying breach of contract suit alleging the agricultural maintenance company negligently inspected a grain silo that subsequently collapsed, causing $1.6 million in losses.

Finding that the Western National policies' exceptions for professional services were triggered by the actions alleged in the underlying suit, a three-judge panel in the Minnesota Court of Appeals on Tuesday affirmed the Hennepin County district court ruling.
