Fidelity Appeals Duty-To-Defend Loss Against Ford

Law360, New York (May 6, 2010, 1:46 PM EDT) -- Fidelity & Guaranty Insurance Co. has appealed a judge's ruling that the insurer was obligated to defend one of Ford Motor Co.'s dealerships in a personal injury suit in 2001.

Fidelity lodged its notice of appeal in the U.S. District Court for the Middle District of Florida on Wednesday. The insurer is appealing the case to the U.S. Court of Appeals for the Eleventh Circuit.

In April, Judge Gregory A. Presnell granted Ford's motion for summary judgment and shot down Fidelity's opposing motion.
