FTC Fights For Antitrust Claims In DuPont Secrets Case

Law360, New York (May 6, 2010, 4:47 PM EDT) -- The Federal Trade Commission is urging an appeals court to revive Kolon Industries Inc.'s antitrust claims against DuPont Co. in a trade secret dispute over DuPont's body armor component Kevlar.

The antitrust watchdog filed an amicus brief Tuesday in the U.S. Court of Appeals for the Fourth Circuit arguing that the lower court had misapplied case law and federal horizontal merger guidelines in dismissing the claim.
