CBOE Asks For Dismissal In Chicago Exchange Battle

Law360, New York (January 19, 2007, 12:00 AM EST) -- The Chicago Board Options Exchange filed a motion Tuesday to dismiss claims made by the rival Boards of Trade for the City of Chicago, arguing that only the Securities and Exchange Commission has jurisdiction over exchange membership rights.

The motion comes just a few days after CBOT filed a motion for partial summary judgment in the case, hoping to win declaratory judgment on claims that CBOE violated its own charter and breached an agreement with CBOT.
