Experts Brainstorm Ways To Step Up Pretrial Process

Law360, New York (May 11, 2010, 12:59 PM EDT) -- Cutting off discovery for defendants who move to dismiss was among the ideas proposed by judges, lawyers and professors at a panel discussion Tuesday on ways to make a more efficient pretrial process and avoid flawed settlements.

U.S. District Judge Paul Friedman of the District of Columbia recommended that rulemakers consider the idea as a remedy for what he called federal judges' unsatisfactory case management methods.

“If a defendant files a motion to dismiss, discovery on the part of the defendant would end,” Judge Friedman said....
