North Atlantic Must Face MTBE Claims: NH High Court

Law360, New York (May 11, 2010, 5:26 PM EDT) -- New Hampshire's highest court has affirmed a trial court's denial of North Atlantic Refining Ltd.'s jurisdictional challenge to a product liability and negligence suit over pollution stemming from the state's importation of gasoline containing now-banned methyl tertiary-butyl ether.

Friday's unanimous opinion by the Supreme Court of New Hampshire held that North Atlantic was subject to the suit, brought by the New Hampshire attorney general in 2003, which claims the refiner knew or should have known that the additive would pollute the state’s waters.
