White House Defends Insurance Mandate In Court

Law360, New York (May 12, 2010, 6:46 PM EDT) -- The Obama administration on Wednesday offered its first court response to allegations the health care law's insurance mandate is unconstitutional, saying that the requirement falls well within the bounds of the Commerce Clause.

Legislation enacted by Congress is rarely struck down by courts, the administration told the U.S. District Court for the Eastern District of Michigan.
