DC Circ. Rejects Challenge To New EPA Lead Air Rules

Law360, New York (May 14, 2010, 6:40 PM EDT) -- A new rule that further limits the amount of lead that can be found in ambient air was upheld Friday by a federal appeals court over the objections of the lead industry, which argued the new rule was unnecessarily harsh and based on bad science.

In siding with the U.S. Environmental Protection Agency, which issued the rule, the U.S. Court of Appeals for the District of Columbia Circuit said it was unconvinced by the plaintiffs' arguments because there was substantial evidence to support the EPA's conclusions....
