Patents Asserted Against R.J. Reynolds Invalid: Judge

Law360, New York (January 22, 2007, 12:00 AM EST) -- Star Scientific Inc. has vowed to appeal after the judge overseeing the company’s patent suit against R.J. Reynolds Tobacco Co. ruled that Star’s asserted patents, which relate to a method of treating tobacco to reduce toxins, are invalid due to indefiniteness.

U.S. District Judge Marvin J. Garbis signed off on an order granting the U.S.’s second largest tobacco company’s motion for summary judgment on Friday, though the entry of final judgment will be suspended until a decision on R.J. Reynold’s inequitable conduct defense is issued....
