Textileather Fights CERCLA Ruling For GenCorp

Law360, New York (May 19, 2010, 7:43 PM EDT) -- Textileather Corp. has appealed a ruling that GenCorp Inc. wasn't liable in a breach of contract suit seeking legal expenses Textileather incurred when it shuttered hazardous waste units at a facility formerly owned by the aerospace and defense giant.

Textileather appealed its defeat to the U.S. Court of Appeals for the Sixth Circuit on Tuesday after a judge dismissed the last remaining claims in the case, which alleged breach of contact and sought relief under the Comprehensive Environmental Response, Compensation and Liability Act.
