German Court Revokes GSK's Advair Patent

Law360, New York (May 20, 2010, 3:01 PM EDT) -- A German court has invalidated a GlaxoSmithKline PLC patent covering inhaled asthma drug Viani, known as Advair in the U.S., handing a victory to Mylan dura GmbH, Hexal AG, Neolab Ltd. and Ivax International BV.

The Federal Patents Court in Munich ruled that a patent covering the combination of Viani's active ingredients was not valid under German law, GSK confirmed Thursday. The decision ends four separate actions brought by Mylan, Hexal, Neolab and Ivax that were all heard in February, according to the British drugmaker....
