India, Brazil Fight Dutch Generic Drug Seizures At WTO

Law360, New York (May 21, 2010, 12:18 PM EDT) -- India and Brazil have launched World Trade Organization complaints against the Netherlands and the European Union, arguing that Dutch authorities violated international law by using patent infringement claims to seize several shipments of generic medications destined for Latin America and Africa.

Both countries have filed requests for consultations, published Wednesday, with the EU and the Netherlands as part of a long-simmering battle over the frequent seizure of generic drugs at European ports for alleged patent violations.
