High Court Will Not Hear Race Discrimination Case

Law360, New York (January 23, 2007, 12:00 AM EST) -- The U.S. Supreme Court on Monday refused to hear a case concerning the standard for determining racial discrimination in employment cases.

In 1995, Anthony Ash and John Hithon, both black men who worked at a Tyson Foods poultry plant in Alabama, applied for shift manager positions. When the manager hired two white men instead, Ash and Hithon sued Tyson for racial discrimination, alleging that the reasons they weren’t promoted were pretextual, since their qualifications were superior to those of the men who were hired.
