Vas-Cath Wins Chance To Appeal USPTO Ruling

Law360, New York (January 24, 2007, 12:00 AM EST) -- Medical device maker Vas-Cath Inc. won an appeal of a patent dispute with the University of Missouri on Tuesday, after a federal circuit judge ruled that the university did not enjoy immunity from federal lawsuits.

The disagreement stems from a patent Vas-Cath was issued for “a catheter for hemodialysis” while the University of Missouri’s patent for the same invention, filed before the Vas-Cath application, was still pending.
