Va. Appeals Court Upholds Permit For Dominion Plant

Law360, New York (May 25, 2010, 6:12 PM EDT) -- A Virginia appeals court has affirmed a lower court's decision to allow energy giant Dominion to receive an air emissions permit for a coal-fueled power plant in southwestern Virginia.

The Virginia Court of Appeals on Tuesday shot down claims brought by Appalachian Voices and other environmental groups that the permit issued by the State Air Pollution Control Board was not valid because it did not regulate carbon dioxide as a pollutant. The appeals court also upheld how the board dealt with particulate matter.
