6th Circ. Halts Tenn. Bank's Forced Rehire Of CFO

Law360, New York (May 25, 2010, 5:17 PM EDT) -- A federal appeals court on Tuesday put the brakes on a U.S. Department of Labor order that Tennessee Commerce Bank rehire a former chief financial officer alleging he was fired for blowing the whistle on violations of the Sarbanes-Oxley Act.

A three-judge panel in the U.S. Court of Appeals for the Sixth Circuit granted Tennessee Commerce's motion to stay enforcement of a preliminary injunction that ordered the bank to rehire ex-CFO George Fort, finding a "substantial question" as to whether a lower court had the authority...
