Homeowners Ask 9th Circ. To Take Up Uponor Fight

Law360, New York (May 26, 2010, 3:01 PM EDT) -- Plaintiffs accusing Uponor Inc. of manufacturing defective plumbing system components have appealed a federal judge's order dismissing the putative class action with prejudice and shooting down their hopes of refiling the suit.

The homeowner plaintiffs filed an amended notice of appeal Tuesday to the U.S. Court of Appeals for the Ninth Circuit, fighting both the judge's dismissal and his refusal to alter his judgment.
