Mass. AG Asks 1st Circ. To Revive State Oil Spill Act

Law360, New York (May 27, 2010, 4:23 PM EDT) -- Massachusetts Attorney General Martha Coakley has asked a federal appeals court to reverse a lower court ruling that prevents the state Department of Environmental Protection from enforcing key provisions of the Massachusetts Oil Spill Prevention Act of 2004.

Coakley filed a notice of appeal to the U.S. Court of Appeals for the First Circuit in the U.S. District Court for the District of Massachusetts on Thursday, saying that the U.S. Coast Guard should be prevented from disabling two particular requirements of OSPA.
