Potash Suppliers Deny Price-Fixing In 7th Circ. Appeal

Law360, New York (June 4, 2010, 9:09 AM EDT) -- Potash suppliers are arguing antitrust claims levied against them by farm supply companies are barred by the Foreign Trade Antitrust Improvements Act and refuting that they conspired to fix prices following an increase in production of the fertilizer ingredient in the 1990s.

The U.S. Court of Appeals for the Seventh Circuit heard oral arguments Thursday in an interlocutory appeal by Agrium Inc., The Mosaic Co., Potash Corp. of Saskatchewan Inc. and other major suppliers who seek the dismissal of the antitrust claims.
