Fed. Circ. Nixes $15.7M Award In Blood Device IP Suit

Law360, New York (June 2, 2010, 6:36 PM EDT) -- The U.S. Court of Appeals for the Federal Circuit on Wednesday vacated a $15.7 million judgment in favor of Haemonetics Corp. in its suit against rival blood processing technology company Fenwal Inc., finding a lower court erred in construing a claim in a patent for a blood separation device.

The Federal Circuit found that the sole patent claim at issue in the dispute has only one clear construction, even if it's not the one the lower court reached, and “even if it renders the claims inoperable...
