China Overturns Pfizer's Viagra Patent

Law360, New York (July 7, 2004, 12:00 AM EDT) -- In a stinging blow to Pfizer, the patent re-examination board of China's State Intellectual Property Office has overturned the company's patent for erectile dysfunction drug Viagra.

In a statement, Pfizer said it was “extremely disheartened by this recent action." The U.S. drug maker said it would appeal, and that its China patent for the anti-impotence drug would remain in effect while it appeals.

SIPO approved Pfizer's patent application for its anti-impotency drug Viagra in late 2001.
