MicroAire Loses Bid For Injunction On Arthrex Device

Law360, New York (June 4, 2010, 12:39 PM EDT) -- A federal judge has dealt a blow to MicroAire Surgical Instruments LLC's patent infringement suit against Arthrex Inc., denying the plaintiff's bid for a preliminary injunction on a rival surgical instrument allegedly based on trade secrets misappropriated by a former MicroAire employee.

Judge Norman K. Moon of the U.S. District Court for the Western District of Virginia on Thursday rejected MicroAire's bid to stop Arthrex from selling its newly redesigned Centerline carpal tunnel surgical instrument, saying that the plaintiff was unlikely to succeed on the merits...
