Nutritional Marketing Claims Raise Ire Of FTC, FDA

Law360, New York (July 2, 2010, 10:38 AM EDT) -- Food companies will need to review their nutritional marketing claims now that federal regulators are increasingly scrutinizing the industry's practices, a move that further opens the door for litigation from plaintiffs attorneys, according to lawyers.

The Federal Trade Commission and an emboldened U.S. Food and Drug Administration have both fired warning shots on the food industry over the past few months, signaling that they are on high alert for misleading health claims — especially those made on products marketed to children.
