9th Circ. Grounds America West Pilots' Seniority Suit

Law360, New York (June 4, 2010, 7:30 PM EDT) -- Citing lack of jurisdiction, a federal appeals court has thrown out a contract dispute brought by former America West Airlines pilots against the U.S. Airline Pilots Association over their loss of seniority following AWA's acquisition by US Airways Inc.

The courts do not have jurisdiction in the matter because the pilots' claim is not ripe and cannot be weighed without considering contingent future events that may or may not occur, the U.S. Court of Appeals for the Ninth Circuit said in a split decision Friday....
