NM High Court Greenlights Proceedings For GHG Cap

Law360, New York (June 7, 2010, 5:33 PM EDT) -- The New Mexico Supreme Court ruled Monday that the state's Environmental Improvement Board can move ahead with rulemaking proceedings to adopt a cap on greenhouse gas emissions.

The ruling came after the court heard arguments from the EIB and an environmental group on one hand and on the other, the state's largest utility, which claimed that the board lacked the authority to institute emissions limits.
